These Terms of Service ("Terms") govern your access to and use of GeoPeeker (the "Service"), operated by Blue 2 Inc., doing business as Bluehouse Group ("we," "us," or "our"). Please read them carefully.

By creating an account, accessing, or using the Service, you agree to be bound by these Terms and by our Privacy Policy, which is incorporated here by reference. If you do not agree, do not use the Service.

Mailing address: 193 South Winooski Avenue, Suite 100, Burlington, VT 05401, USA

1. Eligibility

You must be at least 16 years old to use the Service. By using the Service, you represent that you are at least 16 and that you have the legal authority to enter into these Terms. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

The Service is not directed to children under 16, and we do not knowingly collect their information.

2. The Service

GeoPeeker allows you to view how a website appears and performs from different geographic locations by generating screenshots ("Peeks") from rendering nodes in various regions. Depending on your plan, the Service also offers Auto Peeks (scheduled Peeks), SiteSeeker (uptime, keyword, and SSL monitoring), DNSKeeper (DNS change tracking), alerts by email, SMS, Slack, and in-app notification, Peek history, share links, team access, the API, and other features.

We may modify, add, or remove features at any time. We will provide reasonable notice for changes that materially reduce the functionality of a paid plan.

3. Accounts

3.1 Creating an account

To access most features, you must create an account by providing your first name, last name, email address, and a password. You agree to provide accurate, current, and complete information and to keep it updated.

3.2 Account security

You are responsible for safeguarding your password and API tokens and for any activity under your account. You agree to notify us immediately at [email protected] of any unauthorized use or suspected breach. We are not liable for losses caused by unauthorized account use that you fail to report promptly.

3.3 One account per person

Creating multiple accounts to evade plan limits, rate limits, or other restrictions is prohibited (see Section 8).

3.4 Team accounts

Team plans allow the account owner to invite additional users. The Team plan includes five seats, and more can be purchased as add-ons. Each invited user must create their own account and individually agree to these Terms before accessing the team workspace. Team members can see and manage the team's sites, Peeks, and monitors. The account owner is responsible for plan billing; each individual user is responsible for their own compliance with these Terms.

3.5 Alert contacts

You can add alert contacts, including people other than yourself. If you add another person's email address or phone number, you represent that you have their permission to send them alerts and verification codes from the Service.

4. Plans, Billing, and Renewals

4.1 Plans

We offer a Free plan and paid plans (Solo, Pro, Team), each with the limits and features described on our pricing page. Enterprise plans are available under a separate agreement. Add-on sites may be purchased for an additional fee on any paid plan, and additional seats may be purchased on Team plans. Add-on changes are prorated and apply to your next bill.

4.2 Fees

Current pricing is published at geopeeker.com. We may change pricing for new subscriptions or renewals on at least 30 days' notice. Price changes will not affect the current billing period of an active subscription.

4.3 Payment

Paid plans are billed in advance, monthly or annually depending on the option you select. Payments are processed by Stripe; by providing payment information, you authorize us (through Stripe) to charge your payment method for all fees due.

4.4 Auto-renewal

Paid subscriptions automatically renew at the end of each billing period at the then-current rate for your plan, unless you cancel before the renewal date. You can cancel at any time from Subscription & Billing in your account. Cancellation takes effect at the end of the current billing period; you will retain access to paid features until then. Your account then moves to the Free plan, and Peeks older than the Free plan's retention period are deleted (see Section 6.4).

4.5 30-day money-back guarantee

If you are a new paying customer and are not satisfied with the Service, you may request a full refund of your most recent payment within 30 days of your initial paid subscription by emailing [email protected]. This guarantee applies only to your first paid subscription; subsequent renewals, plan upgrades, and add-on purchases are non-refundable except where required by law.

4.6 Taxes

Fees do not include taxes. You are responsible for any sales, use, VAT, GST, or similar taxes applicable to your purchase, and we may collect these where required.

4.7 Failed payments

If a payment fails, we may suspend or downgrade your account after providing notice. Repeated failed payments may result in termination.

5. Free Plan

The Free plan is offered at no cost, subject to the limits described on our pricing page. Peeks taken on the Free plan carry a GeoPeeker watermark. Free plan accounts can create API tokens and use the API test endpoints, but creating Peeks through the API requires a paid plan. We may modify or discontinue the Free plan at any time. We may also rate-limit, throttle, or suspend Free plan accounts that exceed reasonable usage or that we suspect of abuse.

6. User-Submitted URLs and Peek Results

6.1 Your responsibility for submitted URLs

When you submit a URL to the Service, whether for a Peek, an Auto Peek, or a monitor, you represent that:

  • You have the right to do so under applicable law and under the target site's own terms of use
  • The URL does not contain or trigger malware, illegal content, or material designed to harm third parties
  • The URL does not contain sensitive credentials, session tokens, or other information that you would not want exposed (see Section 6.3)

6.2 License to operate

You grant us a worldwide, non-exclusive, royalty-free license to access the URLs you submit, generate Peeks and monitor checks from them, store the resulting screenshots and metadata, and display them back to you, your team, and recipients of share links you create. This license is solely for the purpose of operating, maintaining, and improving the Service.

6.3 Share links and quick peeks

Peeks you run while signed in are visible only to you and your team unless you create a share link. Anyone who has a share link can view the Peek's screenshots without logging in, until you turn sharing off or the Peek is deleted. Quick peeks run without an account can be viewed by anyone who has the link to the result. We instruct search engines not to index these pages, but anyone with the link can view the result.

You acknowledge and accept that:

  • Submitted URLs and resulting screenshots may be visible to anyone who has the link
  • You should not submit URLs containing authentication tokens, session IDs, or other sensitive query string information
  • We are not responsible for exposure of information you submitted to the Service voluntarily or shared through a link

If you need a Peek result removed before its normal retention period ends, contact [email protected].

6.4 Retention

Peek retention varies by plan (Free: 30 days; Solo: 60 days; Pro: 90 days; Team and Enterprise: 365 days). Quick peeks run without an account are kept for 30 days. Peeks are deleted on a rolling basis after the applicable retention period. If you move to a plan with a shorter retention period, Peeks older than the new period are deleted.

7. SMS Messaging

If you add a mobile phone number to an alert contact and opt in to SMS, you agree to the following in addition to the SMS terms in our Privacy Policy:

  • You represent that the phone number you provide is yours, or that you have the number holder's permission to receive SMS at that number
  • The number will receive SMS only for verification codes and the monitor alerts you have configured
  • Message frequency varies; on average, contacts with alerts configured receive a handful of messages per month
  • Message and data rates may apply, as set by your mobile carrier
  • You can opt out at any time by replying STOP to any GeoPeeker SMS, or by removing the phone number from the contact
  • Reply START to opt back in, or turn SMS on again for the contact
  • Reply HELP for help, or contact [email protected]
  • We are not liable for delayed or undelivered messages
  • If you change or relinquish a phone number, you are responsible for updating the contact; we are not responsible for messages received by a subsequent holder of a number you have stopped using

We do not send marketing or promotional SMS. We do not share SMS opt-in data or mobile phone numbers with third parties for marketing purposes. See our Privacy Policy for full details.

8. Acceptable Use

You agree not to use the Service to:

  1. Violate any law, regulation, or third party's rights
  2. Submit URLs you do not have the right to submit, including those that violate the target site's own terms of use, that require authentication you have not been granted, or that you have been instructed not to access
  3. Attempt to use the rendering nodes, monitors, or any other component of the Service to attack, overload, or otherwise harm third-party systems (for example, by using GeoPeeker as a traffic-generation tool against a target)
  4. Distribute, link to, or attempt to generate Peeks of malware, phishing pages, or content designed to exploit or harm visitors
  5. Distribute, store, or process child sexual abuse material (CSAM) or any content that sexually exploits minors. We report suspected CSAM to the National Center for Missing & Exploited Children (NCMEC) and to law enforcement as required by law
  6. Use the Service to facilitate spam, phishing, harassment, surveillance of individuals, or other abusive activity
  7. Reverse engineer, decompile, or attempt to extract the source code of the Service, except to the extent applicable law expressly permits
  8. Resell, sublicense, rent, lease, or otherwise commercially exploit the Service except as expressly permitted in these Terms (for example, you may use GeoPeeker as part of services you offer to your own clients, but you may not repackage GeoPeeker itself as your own product)
  9. Circumvent rate limits, plan limits, watermarking, or other technical restrictions, including by creating multiple accounts
  10. Scrape, harvest, or systematically extract data from the Service, except through the API under Section 9
  11. Use the Service in violation of US export controls or economic sanctions, including by providing the Service to persons or entities on US-government restricted-party lists
  12. Impersonate any person or entity, or misrepresent your affiliation with any person or entity

We reserve the right to investigate suspected violations and to suspend or terminate accounts that violate this Section.

9. API Access

We offer an application programming interface ("API"). Every plan can use the API test endpoints, and paid plans can also create and retrieve Peeks through it. API access is governed by these Terms together with the API documentation and usage limits we publish. You authenticate to the API with tokens you create in your account; you are responsible for keeping those tokens confidential, and any use of the API authenticated with your tokens will be deemed your use. We may revoke tokens that are used in violation of these Terms.

10. Intellectual Property

10.1 Our IP

The Service, including all software, designs, logos, and content we provide (excluding Peeks of third-party websites), is owned by Blue 2 Inc. and protected by US and international intellectual property laws. Except for the limited license to use the Service granted in these Terms, no rights are transferred to you.

10.2 Your feedback

If you send us suggestions, feedback, or ideas about the Service, you grant us a perpetual, worldwide, royalty-free, irrevocable license to use them for any purpose, without obligation to you. We are free to use feedback without restriction.

10.3 Third-party content

Peeks reproduce third-party website content. We do not own that content, and your right to view or share Peeks of a third-party site does not give you any rights in the underlying content beyond what the third-party site itself permits.

12. Third-Party Services

The Service relies on third-party providers, including Amazon Web Services (hosting, storage, and rendering nodes), Cloudflare (network delivery and security), Stripe (payments), Resend (email), Vonage (SMS), and Google Analytics and HubSpot (analytics). Your use of the Service is also subject to those providers' terms where applicable. If you connect a service such as Slack, your use of that service is governed by its own terms. We are not responsible for the acts or omissions of third-party providers except to the extent of our own contractual obligations to you.

13. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.

WE DO NOT WARRANT THAT:

  • The Service will be uninterrupted, timely, secure, or error-free
  • Defects will be corrected
  • The Service or the servers that make it available are free of viruses or other harmful components
  • The results of using the Service, including monitor checks and alerts, will be accurate, reliable, timely, or meet your requirements

We offer no service-level agreement on any plan. Some jurisdictions do not allow exclusion of implied warranties; in those jurisdictions, the foregoing exclusions apply to the maximum extent permitted by law.

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • IN NO EVENT WILL BLUE 2 INC., ITS AFFILIATES, OFFICERS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING LOST PROFITS, LOST DATA, OR BUSINESS INTERRUPTION, ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES
  • OUR TOTAL CUMULATIVE LIABILITY ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED US DOLLARS ($100)

Some jurisdictions do not allow limitation or exclusion of certain damages; in those jurisdictions, the foregoing limitations apply to the maximum extent permitted by law.

15. Indemnification

You agree to indemnify, defend, and hold harmless Blue 2 Inc. and its affiliates, officers, employees, and agents from and against any third-party claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:

  • Your use of the Service in violation of these Terms
  • URLs you submit or content you cause the Service to render
  • Your violation of any law or third-party right

We will provide reasonable notice of any claim and may participate in the defense at our own expense.

16. Suspension and Termination

16.1 By you

You may cancel a paid plan at any time from Subscription & Billing in your account; paid features remain available until the end of the current billing period, as described in Section 4.4. You may delete your account at any time from your account settings or by emailing [email protected]. Deleting your account ends any paid subscription immediately and permanently deletes your sites, Peeks, and monitors. Your support tickets and your Stripe customer record are kept, the latter for accounting purposes only, as described in our Privacy Policy.

16.2 By us

We may suspend or terminate your access to the Service, with or without notice, if:

  • You materially breach these Terms, including the Acceptable Use policy
  • We are required to do so by law or by a regulatory or carrier authority (including The Campaign Registry or US mobile carriers in connection with SMS)
  • Your account is inactive for an extended period
  • We discontinue the Service or your plan

16.3 Effect of termination

On termination, your right to use the Service ends, and we may delete your account data after the retention periods described in our Privacy Policy. Sections that by their nature should survive termination (including IP, disclaimers, limitation of liability, indemnification, and dispute resolution) will survive.

17. Modifications to These Terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date and, for material changes, provide additional notice (such as a banner on the Service or an email to account holders). Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms. If you do not agree, your sole remedy is to stop using the Service and cancel your account.

18. Governing Law and Dispute Resolution

18.1 Governing law

These Terms are governed by the laws of the State of Vermont, USA, without regard to conflict-of-laws principles. The United Nations Convention on Contracts for the International Sale of Goods does not apply.

18.2 Informal resolution

Before filing any formal legal action, you agree to first contact us at [email protected] with a written description of the dispute. The parties will attempt in good faith to resolve the dispute informally for at least sixty (60) days from the date of that notice before initiating any formal proceeding.

18.3 Venue

Any dispute not resolved informally will be brought exclusively in the state or federal courts located in Chittenden County, Vermont, and the parties consent to personal jurisdiction in those courts. You and we each waive any right to a jury trial.

Notwithstanding the foregoing, either party may seek injunctive or other equitable relief in any court of competent jurisdiction to protect its intellectual property or confidential information.

19. Miscellaneous

19.1 Entire agreement

These Terms, together with the Privacy Policy and any other documents expressly incorporated by reference, constitute the entire agreement between you and us regarding the Service and supersede any prior agreements.

19.2 No waiver

Our failure to enforce any provision is not a waiver of our right to do so later. A waiver is effective only if in writing and signed by an authorized representative.

19.3 Severability

If any provision is held invalid or unenforceable, the remaining provisions will remain in effect, and the invalid provision will be modified to the minimum extent necessary to be enforceable while preserving its intent.

19.4 Assignment

You may not assign these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, sale of assets, or by operation of law.

19.5 Notices

We may give notice to you by email at the address on your account or by posting on the Service. You may give notice to us at [email protected] or by mail at the address above.

19.6 Force majeure

Neither party is liable for delays or failures due to causes beyond its reasonable control, including acts of God, war, terrorism, civil unrest, labor disputes, internet outages, governmental action, or third-party provider failures.

19.7 Relationship

You and Blue 2 Inc. are independent contractors. These Terms do not create a partnership, joint venture, agency, or employment relationship.
